Driver
This terms and conditions ("Agreement") outline the terms of the partnership between Foodarna AB(“Foodarna”/“We”/ “Us”/ “Our”/”Agency”) and Driver (“driver”, “driver partner”, “rider”, “employee”) for the purpose of facilitating food delivery services. By entering into this Agreement, both parties agree to be bound by the terms and conditions outlined herein.
1. Responsibility and hygiene
The driver/rider agrees on taking care of the received equipment and keeping them clean. It is necessary to clean the backpack every Monday and Thursday. The bag must be cleaned after each work shift. If the bag gets dirty during a shift, for example due to spilling of food, it needs to be cleaned before the next order can be placed in the bag. Please do not use chemical washing products to prevent damage to the gear. 2. Stolen or lost gear
In case the gear provided by Foodarna AB is stolen, you have to report it to the HR by opening a ticket. In the ticket, please specify the date of the incident, provide additional details by describing the incident briefly and if you have any proof for the stolen gear. It is mandatory to file a police report for the stolen or lost gear and you have to attach a copy of the report in the ticket. Please note that it is the driver/rider's responsibility to take care of the gear provided by the employer and deductions can be made in your final payslip as specified in section 5 of this agreement for the stolen or lost gear if the above procedures have not been followed.
3. Additional equipment
There are cases in which additional equipment is required. The equipment will be provided to the driver/rider based on the following guideline: >In case of equipment damage, the rider can take the broken item and it will be replaced. > In case the item is lost or stolen, it will be replaced, but replacing the item is added to the riders’ personal inventory list as well. If additional equipment is not in stock, the driver/rider will be contacted when it's available.
4. Storing the equipment
The driver/rider agrees to store the equipment at home between shifts. It is not allowed to store the equipment at the foodarna office, foodarna garage or on any public spaces like train stations or on the street.
5. Timebook
All drivers/riders within Foodarna AB are obliged to fill in a time book. The driver/rider agrees to fill in the time book in accordance with the company routine. The driver/rider can only have one (unfinished) time book at a time. The driver/rider agrees to keep completed time books for one week after they are finished and then directly return them to the employer. The driver/rider agrees that the cost of any missing time books can be deducted from the following salary in accordance with section 6 in this agreement.
6. Returning the equipment
The driver/rider agrees to return the equipment to the employer at the Rider hub/office within 3 days after the employment ends. The thermobag needs to be cleaned and the clothes must be washed. In case the driver/rider does not hand in all the equipment received during the employment period as registered in Foodarna’s inventory system, the driver/rider agrees that the cost of the missing items is deducted from the driver/rider's final salary, and in regards to the time books, from the following salary in accordance with the Swedish law (which is 2 § Lag (1970:215) om arbetsgivares kvittningsrätt in Swedish).
7. Intellectual Property:
7.1 The Driver grants the Agency a limited, non-exclusive, royalty-free license to use the Driver's name, logo for the sole purpose of promoting and facilitating food delivery services.
7.2 The Driver warrants that they have the necessary rights and permissions for any intellectual property provided to the Agency.
8.Confidentiality:
8.1 Both parties agree to keep any proprietary or confidential information obtained during the course of the partnership confidential.
8.2 This confidentiality obligation shall survive the termination or expiration of this Agreement.
9.Termination:
9.1 Either party may terminate this Agreement with a written notice to the other party.
9.2 In the event of termination, the Agency will cease all agency materials, assets that were asigned to the Driver
10.Governing Law and Jurisdiction:
10.1 This Agreement shall be governed by and construed in accordance with the laws of Sweden.
10.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Sweden.
By agreeing to these terms and conditions, both the Agency and Driver acknowledge that they have read, understood, and agreed to be bound by the terms of this Agreement.
